These Terms of Service ("Terms") are a binding agreement between you and MacroBite, Inc. ("MacroBite," "we," "our," or "us") governing your use of the MacroBite iOS app, website, and related services.
1. Acceptance of Terms
By downloading, accessing, or using MacroBite, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and Permitted Use
You may use MacroBite only if you are at least 13 years old and legally capable of entering into a binding agreement. MacroBite is provided for your personal, non-commercial use unless we expressly authorize otherwise in writing.
3. User Accounts
Certain features require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs through your account. You agree to provide accurate information and to update it when necessary.
4. Subscription and Billing
MacroBite may offer paid features or a Pro subscription. Subscriptions purchased through the iOS app are billed by Apple through your Apple ID account, and Apple's billing terms apply to those transactions.
- Pricing, trial periods, renewal terms, and billing intervals may be shown in the app before purchase.
- Unless otherwise stated, subscriptions renew automatically until canceled.
- You can manage or cancel your subscription through your Apple account settings.
- We do not control Apple's billing systems and cannot issue refunds except where required by law or Apple's policies.
5. Nutrition and Health Disclaimer
MacroBite provides nutrition information, macro data, curation, health scoring, and AI-generated suggestions for informational purposes only. MacroBite is not a medical service and does not provide medical, dietary, or treatment advice.
You should not rely on MacroBite as a substitute for advice from a physician, registered dietitian, or other qualified healthcare professional. Restaurant preparation and portions can vary, and actual nutrition values may differ from listed data.
6. AI Features
MacroBite may offer AI-assisted recommendations or order suggestions. These outputs are generated automatically based on your inputs and available data. AI output may be incomplete, inaccurate, or not suitable for your needs, and you remain responsible for your final food choices.
7. Prohibited Uses
You agree not to:
- Use the service in violation of any applicable law or regulation.
- Reverse engineer, decompile, copy, scrape, or extract substantial parts of the service except as allowed by law.
- Interfere with security, performance, or normal operation of the app or website.
- Use automated tools to access the service in a way that imposes unreasonable load or circumvents restrictions.
- Misrepresent your identity, impersonate another person, or access another user's account without authorization.
8. Intellectual Property
MacroBite and its related content, branding, design, software, text, graphics, compilations, and features are owned by MacroBite or its licensors and are protected by intellectual property laws. These Terms do not grant you ownership of the service or any rights except the limited right to use it for personal, non-commercial purposes.
9. Termination
We may suspend or terminate your access to MacroBite at any time if we reasonably believe you violated these Terms, created risk or harm, or used the service in a way that is unlawful or abusive. You may stop using the service at any time and may request account deletion where available.
10. Disclaimer of Warranties
MacroBite is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, accurate, or always available.
11. Limitation of Liability
To the fullest extent permitted by law, MacroBite and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or relating to your use of the service.
To the extent liability cannot be fully excluded, MacroBite's total liability for claims arising out of or relating to the service will not exceed the greater of the amount you paid to MacroBite for the service in the twelve months before the claim arose or fifty U.S. dollars (US $50).
12. Indemnification
You agree to defend, indemnify, and hold harmless MacroBite and its affiliates from and against claims, liabilities, damages, losses, and expenses arising out of your misuse of the service, your violation of these Terms, or your infringement of another party's rights.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict of law rules. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Wayne County, Michigan, and you consent to personal jurisdiction and venue in those courts.
14. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, or other reasonable means. Your continued use of MacroBite after updated Terms become effective means you accept the revised Terms.
